국제노총, 한국정부에 이주노조탄압 강력항의

○ 국제노총(ITUC)은 지난 11월 30일 한국정부의 이주노조 및 공무원노조 간부 구속에 대해 항의서한을 보내 석방을 촉구했습니다.(덧붙임 자료 참조)

○ 국제노총은 이날 항의서한을 통해 까지만 이주노조 위원장 등 3명이 11월 27일 아침 정부의 단속으로 체포된 데 대해 “미등록 노동자들을 포함하여 모든 이주노동자들의 권익을 지키기 위해 활동하고 있는 이주노조 파괴를 목적으로 진행되는 것”이라고 비난했으며 이에 앞서 11월 21일 경기도 안양 동안구청에서 동안구청장 임명자를 면담하고 있던 손영태 공무원노조 위원장, 농성중이던 박광원 공무원노조 안양시지부장 등 12명이 연행되고 이 중 3명에 대해 구속영장을 발부한 것 또한 “공무집행방해와 집행행위금지 위반으로 구속한 것은 국제노동기구(ILO)에 의해 확립된 결사의 자유 원칙을 위배하는 것”이라며 항의했습니다.

○ 아울러 국제노총은 “국제법상 설립신고가 필수적이지 않음에도 공무원노조가 설립신고 절차를 받아들였음에도 상당한 탄압이 계속되고 있다”고 문제제기하며 노조 간부와 활동가들이 체포와 구속이 잇따르는데 대해 “한국이 경제협력개발기구(OECD)와 국제노동기구(ILO)에 가입하던 당시 했던 약속과 모순”이라며 “이주노조와 공무원노조 활동가들을 석방하라”고 촉구했습니다.

○ 민주노총은 이주노조 지도부를 비롯한 노동권 탄압에 대한 지속적인 국제항의 캠페인을 전개하고 있으며, 국제노총을 비롯하여 세계 각국에서 수많은 항의서한이 보내지고 있습니다. 특히 이주노조 지도부 단속 및 탄압에 대해서는 ILO 결사의자유위원회(Committee on Freedom of Association) 제소, 이주민 인권에 관한 UN 특별보고관(Special Rappoteur)에 대한 긴급 서한 발송 등의 활동을 전개하고 있습니다. 민주노총은 미등록 이주노동자라는 이유로 최소한의 인권과 노동권조차도 박탈당하고 있는 현실에 맞서 지속적인 투쟁을 전개할 계획입니다.

○ 국제노총(International Trade Union Confederation)은 2006년 11월 국제자유노련(ICFTU)와 세계카톨릭노총(WCL)이 통합한 국제 노동조직으로 153개국에서 305개 노총이 가맹하고 있으며 전체 조합원수는 모두 1억6천7백만에 이릅니다. 민주노총은 1995년 11월 출범하며 통합 이전 조직인 국제자유노련에 가입했으며 이석행 민주노총 위원장은 현재 국제노총 일반이사회(General Council) 정위원으로 활동하고 있습니다.

이주노조 지도부 및 공무원노조 조합원 체포와 수감

대통령께,

대한민국을 포함하여, 전 세계 153개국에서 모두 1억 6천 7백만 노동자들을 포괄하는 305개 노동조합 조직을 대표하여, 국제노동조합총연맹(ITUC)는 11월 27일의 이주노조(MTU) 까지만 위원장과 라주 부위원장, 마숨 사무국장의 체포와 수감에 대해, 그리고 공무원노조 안양시지부 박문규 동안구지회장과 이호성 정책부장의 연행과 구속에 대해 우려를 표합니다.

국제노총은 미등록 이주노동자들에 대한 격화된 단속의 일환으로 이주노조 지도부가 체포되었다는 소식을 들었습니다. 이러한 단속은 미등록 노동자들을 포함하여, 모든 이주노동자들의 권익을 지키기 위한 활동을 펼치고 있는 이주노조의 파괴를 목적으로 진행되고 있는 것이었습니다. 연행된 세 명의 노조 간부들은 11월 27일 아침에 체포되었습니다.

까지만 위원장은 서울 출입국관리사무소 앞의 항의집회에 참석하기 위해 길을 나선 9시 20분 경 집 앞에서 10명의 출국관리사무소 직원들에 의해 체포되었습니다. 이 과정에서 까지만 위원장은 어깨에 무상을 강하기도 했습니다. 마숨 사무국장 역시 같은 집회에 가는 길에 뒤따라온 10명의 출입국관리사무소 직원들에 의해 체포되었습니다. 라주 부위원장은 일하고 있는 공장 앞에서 잡혔습니다. 직원들은 체포 즉시 그에게 수갑을 채우려 했으며, 라주 부위원장의 요청에 대해 체포 영장을 보이기도 했습니다.

세 명의 노조 간부들은 모두 수도인 서울 남쪽의 충북 청주의 보호소로 이송되었으며, 현재까지도 구금되어 있습니다.

국제노총은 또한 경기도 안양에서 15명의 공무원노조 조합원들이 연행되었다는 소식을 들었습니다. 11월 21일 동안구청에서 농성을 하는 도중, 전경 병력이 침탈하여 박광원 안양시지부장을 포함, 12명의 공무원노조 조합원을 연행한 것입니다. 두 시간 후에는 안양시 동안구청장 임명자를 면담하고 있던 손영태 공무원노조 위원장과 다른 두 명을 회의장에 난입하여 연행하기도 했습니다.

이들은 모두 30여 시간의 구금 끝에 11월 22일 밤 늦게 석방되었습니다. 세 명에 대해서는 법원에 구속 영장이 신청되었습니다. 11월 23일 법원은 박문규와 이호성에 대해 구속을 결정했습니다. 이들에게 현재 적용된 죄목은 형법 상 “공무집행방해”와 공무원법 상 “집단행위금지” 조항 위반입니다. 이 조항은 국제노동기구(ILO)에 의해 확립된 결사의 자유 원칙을 위배하고 있는 조항입니다. 나아가 공무원노조가 정부가 요구한 바 있기도 한 설립신고 절차를 받아들이는 결정을 내렸음에도 불구하고(이것은 사실 공무원노조로서는 긍정적인 입장 변화였습니다. 국제법 상으로는 이러한 설립신고가 굳이 필수적인 것은 아니었기 때문입니다.), 여전히 상당한 탄압이 계속되고 있다는 것을 알게 되었습니다.

국제노총은 남한 내 다른 노동자들과 마찬가지로 이주노동자들 역시 단결할 수 있는 권리와 존엄성이 존중되는 처우를 받을 권리가 있음을 강조하고 싶습니다. 노조 간부와 활동가들에 대한 체포와 구속은 국제법 상 한국의 의무, 특히나 국제노동기구(ILO) 회원국으로서의 의무에 반하는 것입니다. 또한 이것은 한국이 경제협력개발기구(OECD)와 국제노동기구(ILO)에 가입하던 당시 했던 약속과도 모순되는 것이며, 그 약속들은 여전히 지켜지지 않고 있습니다.

저는 이주노조의 위원장과 부위원장, 사무국장의 석방과 두 명의 공무원노조 활동가들의 석방을 강력히 요청합니다. 나아가, 저는 두 명의 공무원노조 활동가들에게 적용되고 있는 모든 혐의를 취하할 것을 요구합니다.

Arrest and detention of the MTU leadership and KGEU trade unionists

Dear President,

The International Trade Union Confederation (ITUC), representing 305 trade union organisations, with a total membership of 168 million workers in 153 countries and territories, including Korea, is concerned about the arrest and detention of the President of the Migrants' Trade Union (MTU), Mr. Kajiman, Vice President Mr. Raju and General Secretary Mr. Masumon 27 November, and the arrest and continued detention of Park Moon Gyu, Head of Dongan-gu(ward) Local of KGEU Anyang City Chapter and Lee Ho Seong, Policy Director of KGEU Anyang City Chapter.

The ITUC has been informed that the MTU leadership were arrested in the wake of an intensified crackdown on undocumented migrants, in order to stifle the union that defends the interest of all migrant workers, including undocumented workers. All three leaders were rounded up and arrested in the morning on 27 November.

Mr. Kajiman was arrested by 10 immigration officers in front of his home at about 9.20 am, just as he left to attend a protest in front of Seoul Immigration Office. His shoulder was hurt in the process. Mr. Masum was on his way to the same protest, when about 10 immigration officers come up from behind him on the street and arrested him. Mr. Raju was arrested in front of the factory where he works. The officers immediately tried to handcuff him, and upon his request they showed him a detention order issued against him.

All three leaders were sent to a detention center in Cheongju, Northern Choongjeong Province, south of the capital Seoul, where they are still detained.

The ITUC has also been informed about the arrest of 15 KGEU members in Anyang, Gyeonggi-do (province). During a sit-in at the Dongan-gu office building on 21 November, riot police arrested 12 members of the KGEU, including Park Gwanf Won, Chair of the KGEU Anyang Chapter. Two hours later the President of the KGEU Son Young Tae, along with two other KGEU members had a meeting with the Head Officer of the Dongan-gu (ward) of Anyang City. During the meeting riot police stormed the room and arrested them.

All of them were held for about 30 hours and released late in evening on 22 November. Three were bought before court to have their detention prolonged. on 23 November the Court decided that only Park Moon Gyu, and Lee Ho Seong had to remain detained. They are now charged under the Penal Code for "Obstruction of Performance of Official Duties" and for breeching the "Prohibition of Collective Action" under thePublic Officials Act, which is in breach of the principles of Freedom of Association established by the International Labour Organization. Furthermore, the KGEU informs us that despite their decision to accept the legalisation process requested by the government (which was a sign of goodwill from the union, not a necessary requirement under international jurisprudence), the union still suffers a great deal of repression.

The ITUC would like to emphasize that migrant workers, like other workers in South Korea, have the right to organise and be treated with dignity and respect. The arrest and detention of trade union leaders and activists are contrary to Korea's obligations under international law, including and especially, those deriving from its membership of the International Labour Organisation. They also contravene the commitments made to the OECD and the ILO by Korea when it joined these world bodies, commitments that have long remained unfulfilled.

I strongly urge you to release the President, the Vice-President and the General Secretary of the MTU and the two KGEU activists. Furthermore, I urge you to drop all charges against the two KGEU activists.
